MarkClear mobile app and website

1. The Service

MarkClear provides AI-powered image tools: watermark removal (Fast and Pro quality), photo-to-cartoon stylization in several artistic styles, and a free on-device image adjust tool (resize, rotate/flip, format conversion, compression). The service is operated by MarkClear ("we", "us") at https://markclear.top.

2. Your Commitment About Images

• You confirm that you own or otherwise have the right to process every image you submit, including removing watermarks from it. Processing content you do not own may infringe the rights holder's copyright; you alone are responsible for the images you submit.
• You may not use the service to process unlawful content, including images depicting minors inappropriately, or content that violates applicable law.

3. Credits, Purchases, and Refunds

• New users receive a small free credit quota (currently 3 credits, fast quality only, per device). The free quota has no cash value.
• Additional credits are sold as one-time consumable packs. Credits never expire while the service is offered.
• In the iOS app, purchases are made exclusively through Apple In-App Purchase and are governed by Apple's terms; on the website, checkout is processed by Creem. We never receive your payment credentials.
• Credit prices per edit (fast quality, pro quality, photo-to-cartoon) are shown in the app before you submit an edit and may change over time; changes never affect credits already in your balance.
• If a processed edit fails, the credits charged for it are automatically returned to your balance. Refunds of purchases are handled by Apple (reportaproblem.apple.com) or, for website purchases, by contacting us; when a refund is approved, the credits from that purchase are removed from your balance.
• Deleting your account forfeits any remaining credits, including purchased credits (see our Privacy Policy for what deletion covers).

4. Image Processing and Retention

Images you submit are transmitted over HTTPS, used solely to perform the edit you requested, and automatically and permanently deleted from our servers within 24 hours. Cloud processing is performed by the third-party AI providers disclosed in our Privacy Policy. On iOS, your history is stored only on your device.

5. Acceptable Use

• Do not attempt to disrupt, overload, or reverse-engineer the service, or to bypass credit accounting or purchase verification.
• Do not resell access to the service without our written permission.
• We may suspend accounts that abuse the service or the free quota.

6. Your Content

You retain all rights to the images you submit. You grant us and our AI processors only the limited right to transmit and process the image in order to perform the edit you requested. We do not use your images to train models and claim no ownership of your content or results.

7. No Warranty

The service is provided "as is" and "as available" without warranties of any kind, express or implied, including fitness for a particular purpose or that results will meet your expectations. AI-generated results may contain artifacts; review each result before relying on it.

8. Limitation of Liability

To the maximum extent permitted by law, our aggregate liability arising from your use of the service is limited to the amount you paid us for credits in the twelve months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

9. Changes to the Service or These Terms

We may modify or discontinue parts of the service and may update these Terms. The "Effective date" at the top shows the latest revision; material changes will be highlighted in the app or on the website. Continued use after an update means you accept the revised Terms.
